These terms govern your use of Kaizen Maxxing, a nutrition and workout tracking application operated by Zamorano Productions. By creating an account or using the app, you agree to these terms.
1. What Kaizen Maxxing is
Kaizen Maxxing helps you log meals, track calories and macronutrients, and set personal targets, optionally informed by body composition data such as a DEXA scan. Registration is open to the public.
2. Not medical advice
Kaizen Maxxing is not a medical device and does not provide medical, nutritional, or health advice. Calorie and macro targets are estimates produced by standard formulas and depend on the accuracy of the numbers you enter. Consult a qualified professional before making significant changes to your diet or exercise, especially if you have a medical condition. Never disregard professional advice because of something this app calculated.
3. Your account
- Provide accurate information and keep your sign-in credentials secure.
- Email and password accounts must verify their email address.
- You are responsible for activity under your account.
- One account per person.
4. Acceptable use
Do not attempt to access other users' data, disrupt or reverse engineer the service, abuse shared features, evade security controls, or use the app for anything unlawful.
5. Your data
You own the data you enter. We handle it as described in the Privacy Policy. You can request deletion of your account and data at any time.
6. Availability and data loss
The app is provided free of charge. We aim to keep it running, but it is provided "as is" and "as available," with no guarantee of uptime, error-free operation, or protection against data loss. Use the JSON and CSV downloads in Settings to keep independent records of anything you cannot afford to lose.
7. Limitation of liability
To the maximum extent permitted by law, Zamorano Productions is not liable for any indirect, incidental, or consequential damages arising from use of the app, including decisions made based on its calculations. The app's total liability for any claim is limited to the amount you paid to use it, which is zero.
8. Termination
You may stop using the app at any time and request account deletion. We may suspend or remove accounts that violate these terms or when the service is discontinued.
9. Changes to these terms
If these terms change, the effective date above will be updated and material changes will be communicated in the app. Continued use after changes means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
